2. General
By using this website or purchasing products, you agree to these Terms. If you disagree, do not use the site. We may update these Terms; continued use means acceptance. Changes won't affect confirmed orders. Governed by Portuguese law (Decree-Law 24/2014, 84/2021, Law 24/96) and EU regulations. Your statutory consumer rights remain unaffected.
3. Account Registration
Registration is free. Credentials are personal/non-transferable. Delete account anytime via email.
4. Products and Availability
We choose products offered. Descriptions accurate but minor variations possible (colour/texture due to materials/screens). No defects from variations.
5. Pre-Contractual Information
Before purchase (per Decree-Law 24/2014 Art. 4): product details, total price (incl. VAT/delivery), payment/delivery terms, withdrawal rights, guarantee shown clearly. "Place Order" confirms payment obligation. Return shipping your cost for non-defect withdrawals.
6. Pricing and Payment
Prices include VAT; delivery costs shown separately at checkout. Pay upfront. Methods: cards, MB Way, Multibanco. Digital invoice emailed.
7. Shipping and Delivery
Mainland Portugal: 7-14 business days estimate. Notify delays. Cancel pre-shipment for refund. Not liable for force majeure (notify + refund/resent option). Responsible until possession.
8. Right of Withdrawal
14 days from possession (Decree-Law 24/2014 Arts. 10-17). Notify via email/model form. Return within 14 days. Deduct value loss if handled beyond inspection. Exceptions: custom goods. Refund full price + standard delivery (premium not). Return shipping yours unless defect.
9. Refunds
Within 14 days of notice/goods receipt. Same method. Free return shipping if our fault.
10. Legal Guarantee and Support
3 years conformity guarantee (Decree-Law 84/2021). Remedies: repair > replace > reduction > refund. Contact with order/photos. Excludes misuse/wear.
11. Limitation of Liability
No liability except gross negligence/fraud/injury/death or mandatory law. No consequential damages.
12. Intellectual Property
All content property of Evervida. No unauthorized use.
13. Privacy and Data Protection
See Privacy Policy. Bases: contract/legal/legitimate interest. Rights per GDPR/Law 58/2019. Complain to CNPD (www.cnpd.pt).
14. Complaints — Livro de Reclamações
Registered: www.livroreclamacoes.pt (Decree-Law 156/2005). ASAE supervisor. DGC: www.consumidor.gov.pt.
15. Alternative Dispute Resolution
ADR entities: www.consumidor.gov.pt. EU ODR: ec.europa.eu/consumers/odr. Resolve within 30 days.
16. Governing Law
Portuguese law. Disputes: Faro District courts (consumer residence rights per Rome I).
